Do I need a lawyer just to buy or sell a house?

The short answer:  YES.

Selling or buying a home can affect your financial future; your whole family's standard of living for years to come.  It is probably the biggest investment of your life. You need all the protection you can get.

But what about the mortgage lender, your Realtor, and the title company.  Won't they see to it that everything is in order?  Probably not.  Their interests and yours are not the same.  You want good title to a home to live in.  You want to get the house you are paying for.  You want to cut your closing costs. You want to get your deal done and over with.

The lender wants to make a profitable loan that will be repaid. Your closing costs are not their problem, as long as you can pay the mortgage.  Some title matters can potentially haunt you without affecting your lender, so you can't expect them to protect you.

It is likely that your transaction would not have taken place but for the efforts of your Realtor.  However, his or her expertise does not extend to title and other technical matters.  A good Realtor will do everything possible to help you, but he or she will be the first to tell you that only an experienced real estate lawyer is qualified to protect you in the legal aspects of your transaction.

The title company issues an insurance policy that guarantees the good title to your home.  Did you know that title insurance can leave out specific title problems, just by listing them in the policy?  Chances are that you will never know about title exceptions until you try to sell your real estate.   Competent real estate counsel understands title insurance, and can help deal with title problems before it's too late to avoid them.

The bank, the Realtor and the title company have their own jobs to do.  Your attorney's only job is to protect you.
